For You v Anxiety – The Academy, Courses & LynBot

1. Introduction

These Terms & Conditions (“Terms”) govern your use of You v Anxiety – The Academy, Courses & LynBot, operated by Lyn Penman, sole trader, trading as You v Anxiety. Services may also be provided in future through Mental Wellbeing Solutions Ltd, registered office: 128 City Road, London, EC1V 2NX (“Company”, “we”, “us”).

By purchasing, enrolling, or accessing our Services, you agree to be legally bound by these Terms.

2. Definitions

“Services” – courses, memberships, hypnosis recordings, resources, and LynBot.
“User,” “you,” “your” – any individual purchasing or using our Services.
“The Now Step® Method” – our proprietary CBT-based therapeutic method.
“LynBot” – our AI-supported chatbot, powered by Chatbase.
“Contract” – the agreement formed when you accept these Terms.

3. Eligibility

Services are available only to individuals aged 16 and over.
By enrolling, you confirm that you do not suffer from active psychosis or uncontrolled epilepsy, as hypnosis may be recommended as part of the courses.

4. Services Provided

We provide:
- Online courses, memberships, and resources.
- Digital products including hypnosis recordings.
- LynBot – AI-based support and guidance.

We may modify or discontinue Services at any time.

5. Medical Disclaimer

Our Services, including LynBot and any hypnosis recordings, are for educational and support purposes only.
They are not a substitute for medical advice, diagnosis, or treatment.
We do not provide emergency support. If you are in crisis, call 999 (UK) or your local emergency services.

6. Subscriptions & Payments

Memberships are billed on a recurring monthly basis.
Payments are processed securely by Stripe.
You may cancel at any time by emailing lyn@lynpenman.com.
Cancellation is effective at the end of the billing cycle.
Refunds are subject to UK consumer law, including the 14-day cooling-off period (see Refunds & Cancellations Policy).

7. Intellectual Property

All content, courses, recordings, hypnosis tracks, PDFs, and resources are owned by us.
The Now Step® Method is a registered method and is the intellectual property of Lyn Penman / Mental Wellbeing Solutions Ltd.
Users are granted a limited, non-transferable licence for personal use only.
You may not copy, reproduce, distribute, or resell any content without written permission.

8. Acceptable Use

You agree not to:
- Share login details with others.
- Misuse LynBot (e.g. abusive, harmful, or illegal use).
- Attempt to copy or resell Services.

9. LynBot Disclaimer

LynBot is powered by Chatbase AI.
Conversations are temporarily stored on secure servers in the United States and deleted weekly.
LynBot is not therapy and does not replace a professional consultation.
You are solely responsible for how you use its guidance.

10. Service Availability

We aim to provide reliable access, but we do not guarantee uninterrupted service. We may suspend Services for maintenance, technical, or security reasons.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:
- Any reliance placed on our content.
- Any damages, losses, or injuries resulting from use of our Services.

We do not exclude liability for death or personal injury caused by negligence, fraud, or any matter which cannot be excluded under UK law.

12. Indemnity

You agree to indemnify and hold us harmless against claims, damages, costs, or liabilities arising from your misuse of our Services.

13. Termination

We may terminate or suspend your access without notice if:
- You breach these Terms, or
- You misuse our Services.

14. Force Majeure

We shall not be liable for delays or failure to perform due to events beyond our reasonable control (including strikes, system failures, pandemics, or natural disasters).

15. Severability

If any provision of these Terms is found invalid, the remaining provisions remain in full force and effect.

16. Waiver

Our failure to enforce any right does not constitute a waiver of that right.

17. Assignment

You may not transfer your rights or obligations under these Terms. We may assign our rights and obligations without restriction.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
